Land Deed - Archibald and Mary F. Quarles to Benjamin S. Arnold

This indenture, made this 29th day of May 1851 between Archibald Quarles and Mary F. Quarles, his wife, of Franklin County & State of Kentucky, of the first part, and Benjamin S. Arnold of the same county & state, of the other part, witnesseth:

That the said Quarles and wife, for and in consideration of the sum of twenty dollars to him in hand paid, the receipt whereof is hereby acknowledge, hath granted, bargained, sold & conveyed & by these presents do grant, bargain, sell, alien, convey & confirm unto the said Arnold & his heirs and assigns forever, all the right, title, interest and claims of them, the said Quarles & wife, with the tract of land on which the said Benjamin S. Arnold now resides, situate and being in said County of Franklin on the water of Elkhorn Creek containing sixty acres, more or less, the interest interest, right, title and claim in & to the same hereby intended to be conveyed being that which descended to the said Archibald Quarles as one of the children and heir at law of William E. Quarles, decd, and which he hath acquired by purchase and conveyance from Horatio J. Harris and Martha L. Harris, his wife, and Egbert Q. Arnold.

To have and and to hold the interest, right, title and claim in and to said tract of land above described with the appurtenances, rights & privileges thereto belonging or in any wise appertaining unto the said Arnold, his heirs and assigns forever, and the said Quarles and wife for themselves their heirs & the said interest, right, title and claim in the said tract of land and premises unto said Arnold, his heirs and assigns forever, do and will forever warrant and defend by these presents.

In witness whereof, said Quarles and wife have hereto set their hands and seals the date above.

I, Alexander H. Rennick, Clerk of the County Court for the County of Franklin, do certify that the written deed from Archibald Quarles and Mary F. Quarles, his wife, to Benjamin S. Arnold was produced to me in my office on the 29th day of May 1851 and was acknowledged by the said Archibald Quarles to be his act and deed.

And afterwards, on the first day of November 1851, she, the said Mary F. Quarles, being by me examined privily and apart from her husband, deceased, that she did truly and willingly seal and deliver the said writing and wishes not to retract it, acknowledged the said writing again ____ and explained to her to be her act and deed, and consenteth that the same maybe recorded.

Whereupon the said deed, together with this certificate, have been truly recorded in my office.

Witness my hand as clerk this 5th day of November 1851.
