Land Deed - Isaac Arnold, et. al., to Samuel Fisher

This indenture, made the tenth day of July in the year of our Lord one thousand seven hundred and ninety two, between Isaac Arnold of the County of Fauquier and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, each of the county aforesaid, and Seymore Arnold of Culpeper County and Mary his wife of the one part and Samuel Fisher of Fauquier County of the other part.

Witnesseth that the said Isaac Arnold and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife, for and in consideration of the sum of twenty four pounds one shilling and eight pence Virginia currency, to them in hand paid by the said Samuel Fisher at or before the sealing and delivery of these presents, the receipt whereof they do hereby acknowledge and thereof doth release, acquit and discharge the said Samuel Fisher, his heirs, executors and administrators by these presents, they the said Isaac Arnold and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife, and have granted, bargained, sold, aliened and confirmed, and by these presents do grant, bargain, sell alien and confirm unto the said Samuel Fisher one certain tract or parcel of land, situate, lying and being in the said County of Fauquier, being part of a tract formerly the property of Humphrey Arnold, deceased, and bounded as followeth, viz.

Beginning at a hiccory bush in Mr. Wily Roy's line, thence with his line S88½ E24 poles to a large white oak corner to Roy, thence with another of Roy's line S30 W49 poles to a hiccory corner to Roy and Gordain, thence with Gordain S18½ E112 poles to two large white oaks corner to Gordain, thence S27 W18½ poles to a white oak in Gordain's line corner to Porter, thence with Porter N40 W31 poles to a stake in an old field, thence S65 W22 poles to a stake corner to John West, thence with West's line N33½ W49 poles to a stake corner to Porter's half acre lott, thence with his lines N47 E 9½ poles to a stake, thence N40 W8 poles to a stake, thence to the beginning, containing thirty four acres and all houses, buildings, orchards, ways, water and watercourses, profits, commodities, ____ and appurtenances whatsoever to the said premises hereby granted or any part thereof belonging or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof and also all the estate, right, title, interest, use, trust, property, claim and demand whatsoever of them, the said Isaac Arnold and Mary his, Benjamin Arnold and Sarah his wife, George Arnold and Anne his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife and or their heirs, of, in and to the said premises and all deeds, evidences and writing touching or in any wise concerning the same.

To have and to hold the said thirty four acres of land and all and singular, other the premises hereby granted and sold and every part and parcel thereof with their and every of their appurtenances unto the said Samuel Fisher, his heirs and assigns forever to the only proper use and behoof of him the said Samuel Fisher and of his heirs and assigns forever, and the said Isaac and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife and for themselves, their heirs, executors and administrators do covenant, promise and grant to and with the said Samuel Fisher, his heirs and assigns, that they now at the time of sealing and delivery of these presents are seized of a good, sure, perfect and indefeasible estate of inheritance in fee simple of and in the premises hereby granted and sold and that they have good power and lawfull and absolute authority to grant and convey the same to the said Samuel Fisher in manner and form aforesaid and that the said premises now are and as forever hereafter shall remain and be free and clear of and from all other and former gifts, grants, bargains, sales, dower, right and title of dower, judgments, executions, titles, ____, charges and encumbrances whatsoever made, done, commited or suffered by the said Isaac Arnold and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife and their heirs or any other person or persons whatsoever.

And lastly that the said Isaac Arnold and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife and and their heirs all and singular the premises hereby granted and sold with their appurtenances unto the said Samuel Fisher, his heirs and assigns themselves, their heirs, executors and administrators and all, any, every other person or persons whatsoever shall and will warrant and forever defend by these presents.

In witness whereof, the said Isaac Arnold and Mary his wife, Benjamin Arnold and Sarah his wife, George Arnold and Anna his wife, John West and Bathsheba his wife, Seymore Arnold and Mary his wife and have hereunto set their hands and seals the day and year above written.

At a court held for Fauquier County the 24th day of September 1792.

This indenture was proved to be the act and deed of the said Seymore Arnold by the oath of Martin Pichett, a witness thereto, and to be the act and deed of the said Isaac Arnold by the oaths of Joseph Martin and Josiah Holtzclaw, witnesses thereto, and acknowledged by the said Benjamin Arnold and George Arnold to be their act and deed and ordered to be certified.

And at a court for the said county the 22nd day of October 1792.

The same was further proved to be the act and deed of the said Seymore Arnold by the oath of Edward Digges Junr., a witness thereto, and to be the act and deed of the said Isaac Arnold by the oath of Benjamin Holtzclaw, a witness thereto, and to be the act and deed of the said George Arnold by the oaths of Jeremiah French and George Gordain, witnesses thereto, and acknowledged by the said Anna (she being first privily examined as the law directs) to be her act and deed and ordered to be certified.

And at a court held for the said the 27th day of February 1797.

The same was further proved by the oath of William Horner, another witness thereto and ordered to be recorded.
