Land Deed - John C. and Elizabeth Bates to Benjamin S. Arnold

This indenture, made this 24th day of July in the year of our Lord 1856, between John C. Bates and Elizabeth Bates, his wife, of the County of Franklin and State of Kentucky of the one part, and Benjamin S. Arnold of the County of Franklin and State aforesaid of the other part, witnesseth:

That the said Jn C. Bates and Elizabeth Bates, his wife, for and in consideration of the sum of one hundred and fifty dollars in hand paid, the receipt whereof is hereby acknowledge, have granted, bargained and sold, and by these presents do grant, bargain and sell unto the said Benjamin S. Arnold, his heirs and assigns forever, all that tract or parcel of land situate and being in the County of Franklin and State of Kentucky on the water of Elkhorn being the undivided one eighth part of the tract of land on which the said Benjamin S. Arnold now lives, which descended from William E. Quarles, deceased, to his children of whom Elizabeth Bates one, the said Elizabeth owning the said undivided one eighth part of said tract of land containing about ninety acres be the same more or less.

Said land is bounded on the north by the land of Harry Suter, on the east by the land of Alfred Tyler, on the south by the land of Wm G. Harvie, on the west by the land of Elizabeth Quarles.

A deed of conveyance was heretofore made and acknowledged by the said Jn C. Bates and Elizabeth Bates, his wife, before the clerk of the County Court for Franklin County, foresaid interest but said deed has not been recorded and is lost or misplaced.

The consideration mentioned in said deed is the same mentioned in this deed and ____ one sum of one hundred and fifty dollars has passed between them and this deed in lien thereof.

Together with all and singular the appurtenances thereunto or in any wise appertaining.

To have and to hold the land hereby conveyed with the appurtenances unto the said Benjamin S. Arnold, his heirs and assigns forever.

And the said parties of the first part for themselves, their heirs, executors and administrators, the aforesaid tract of land and appurtenances unto the said Benjamin S. Arnold, his heirs or assigns, against the claim or claims of all and every person or persons whatsoever claiming or claim the same do and will forever warrant and defend by these presents.

In witness whereof, the said parties of the first part have hereunto set their hands & seals the day and date first above mentioned.

I, Alexander H. Rennick, Clerk of the Franklin County Court, do certify that the written deed from John C. Bates and Elizabeth M. Bates, his wife, to Ben S. Arnold was produced to me in my office on the 24th day of July 1856 and was acknowledged by the said John C. Bates and Elizabeth M. Bates to be their act & deed and the same with this certificate have been truly recorded in my office.
