Land Deed - William G. Harvie and Caroline Harvie to Benjamin S. Arnold

This indenture, made the 25th day of Septr. In the year of our Lord 1838, between William G. Harvie and Caroline Harvie his wife, of the County of Franklin and State of Kentucky of the one part, and Benjamin S. Arnold of the County Franklin & State aforesaid of the other part, witnesseth:

That the said William G. Harvie & Caroline his wife, for and in consideration of the sum of six hundred dollars in hand the receipt whereof is hereby acknowledged, have granted, bargained, and sold and by these presents doth grant, bargain and sell unto the said Benjamin S. Arnold, his heirs and assigns, forever, all that tract of land below the mouth of Elkhorn and on the Kentucky river, it being the same tract of land whereof William E. Quarles lived & died on, and supposed to contain four hundred acres, and which was divided by Tunstall Quarles to William E. Quarles & his wife during their natural lifetime and then to descend to the heirs of William E. Quarles, and the said William G. Harvie holding by purchase the share of William Quarles and with his wife's share making the above two shares.

Together with all and singular the appurtenances thereunto belonging, or in any wise appertaining.

To have and to hold the land hereby conveyed with the appurtenances, unto the said Benjamin S. Arnold, his heirs and assigns, forever.

And the said William G. Harvie & Caroline his wife for themselves, their heirs, executors, and administrators, the aforesaid tract of land and appurtenances, unto the said Benjamin S. Arnold, his heirs or assigns, against the claim or claims of all and every person or persons whatsoever doth and will forever warrant and defend, by these presents. In witness whereof, the said William G. Harvie and Caroline Harvie his wife have hereunto set their hands & seal, the day & date first above written.

Acknowledged in presence of
Franklin County, I, A. H. Rennick, clerk of the County Court for the County afsd, do certify that the written deed from Wm. G. Harvie & Caroline Harvie to Ben S. Arnold was produced to me on the 26th day of Septr. 1838 & was acknowledged by the sd Wm. G. Harvie to be their act & deed, and the said Caroline Harvie being examined by me privily & apart from her husband, declared that she did freely & willingly seal & deliver the sd writing, & wishes not to retract it, & acknowledged the sd writing again ____ and explained to her to be her act & deed, & also relinquished her right of dower in & to the premises he conveyed and consenteth that the same might be recorded as such.

Whereupon the said deed together with this certificate is truly recorded in my office.

Given under my hand as clerk as aforesaid the date above written.
